U's Privacy Policy

CyberLink Corp. (“CyberLink,” “U,” “U App,” “U Messenger,” “U Meeting,” “U Webinar,” "we" or "us") provides internet-based instant messaging, multimedia content sharing services, as well as client applications available across multiple platforms (the “Service”). We acknowledge your right to online security. Please read this statement to better understand how we handle your personal information. This Policy explains how we process your personal data when you use our Services. By continuing to use our Services, you agree to be bound by the following Privacy Policy.

Entities collecting personal information

CyberLink Corp. collects personal information through websites and mobile applications developed by CyberLink (hereinafter referred to as the “Service”). CyberLink’s address is 15F., No.100, Minquan Rd., Xindian Dist., New Taipei City 231, Taiwan (R.O.C.), and the phone number is +886-2-8667-1298. CyberLink.com Corp. (U.S.), CyberLink Corp. (Taiwan), CyberLink Inc. (Japan), and CyberLink Europe B.V. (Netherlands) may store, transfer, and process the information collected through the Services developed by CyberLink. All transfers are conducted in accordance with applicable data transfer laws and regulations.

Information We Collect

We collect information to provide better services for all users, such as basic information like the language you use, as well as more complex information, such as the ads you find useful. The information we obtain from users helps us personalize and continuously improve our Services. The following are some examples of the information we collect for these purposes.

User Information

  • email address/password, U account details, or personal descriptions and photos in your profile;
  • transactions or orders you make;
  • registering to attend a U Meeting or U Webinar;
  • billing and payment for our products;
  • participation in discussion groups or forums;
  • cookies, user IP address, device information (such as operating system type, serial number, mobile advertising ID, hardware information, etc.), browser type, and/or browser language used whenever you interact with us;
  • your location (if you enable location services while using our Services);
  • anonymous location data, including but not limited to users’ geographic location and the Wi-Fi networks to which the user’s device is connected or within range;
  • service-related, diagnostic, crash report, and performance information, including details about your activities (such as how you use our Services and how you interact with others through our Services), logs, and diagnostic, crash, website, and performance records and reports;
  • online and status content changes within our Services, such as whether you are online (your “Online Status”), the last time you used the Services (your “Last Seen Status”), and the time you last updated your status message;
  • device-specific information when you install, access, or use our Services, such as hardware model, operating system information, browser information, IP address, mobile network information, and device identifiers. We collect device location information only when you use our location features (for example, when you choose to share your location with contacts, view nearby locations, or others share their location with you), and for diagnostic and troubleshooting purposes such as when you are unable to use our Services properly;
  • analytical information related to your usage behavior, such as how you use and how frequently you use our Services; this includes file types (e.g., photos or videos), file names, file extensions, and local paths of files that you input to the apps, wherein this analytical information does not reveal any information of any photo, video, or any data you input into our Services, and the aggregated information or data are collected solely for analytical purposes without targeting any specific individual/user; where the analytical information is collected through third-party providers such as Flurry, Google Firebase Analytics (see our partner’s privacy statement), and Facebook Analytics (see our partner’s privacy statement);
  • feedback and suggestions you provide to our support center, “Feedback” / “Report an Issue” pages, and/or our customer service contacts; and
  • when using our Services on Windows, we will use a Unique User ID (UUID) to uniquely identify your device; this UUID is generated by combining Windows Security Identifier (SID) on your computer with a randomly generated large number, which enable us to identify the specific computer on which our Services is installed; you may reset this UUID on your device by closing all CyberLink products on your computer and remove this registry key using the Windows Registry Editor at: Computer\HKEY_CURRENT_USER\Software\CyberLink\CBE

As a user, you are not required to provide any personal information to participate in various activities. For other activities, such as subscribing to newsletters or marketing materials, you are entirely free to opt out if you do not wish to receive any of these materials. Depending on the activity, certain information we request may be mandatory, while other information is optional. If you do not provide the mandatory information required for using our Services, you may be unable to continue using the Services. Please note that we do not sell, rent, or otherwise disclose your personal information. We may collect non-personal information in certain contexts and combine or store it together with personal information. As long as such non-personal information remains combined with personal information, it will be treated as personal information. To provide you with a comprehensive service experience, if you are a user located in Taiwan (R.O.C.) and choose to communicate with other users in Taiwan (R.O.C.) via U, your personal data will be stored on Google Cloud servers located in Taiwan (R.O.C.) and will not be transferred outside Taiwan. However, if you are a user outside Taiwan (R.O.C.), or choose to communicate with users outside of Taiwan (R.O.C.) via U, your personal data may be transferred to and stored on Amazon Web Services (AWS) cloud servers in Tokyo, Japan, or Oregon, United States, and will be handled appropriately in accordance with applicable privacy protection regulations. Based on our assessment, the levels of personal data protection in Japan and the United States are generally equivalent to or exceed the relevant personal data protection regulations of Taiwan (R.O.C.). We will continue to implement reasonable and necessary technical and organizational security measures in accordance with applicable laws and regulations to ensure that your personal data is properly protected, providing safeguards equivalent to those in Taiwan (R.O.C.).

The content you post, including your charts, photos, videos, voice messages, files, stickers, and shared location information (collectively referred to as “Content”), will be retained by us in the ordinary course of providing our Services to you.

Purpose of Using Collected Information

The user information we collect is used for the purposes listed below. To protect your rights, we classify these purposes as "Essential Information Uses" and "Non-Essential Information Uses" based on the importance of the purpose.

You may freely choose whether to provide non-essential information or allow its processing, and you may contact us to opt out at any time. Opting out will not affect your ability to use the core features of our Services.

- Purposes for Using Essential Information (required for contract fulfillment or to provide core functionalities):

  • to provide our Services to you;
  • for purposes of customer service, security, archival and backup related to our Services;
  • to prevent any user from misusing the Services;
  • to develop new services and enhance existing services;
  • to enable account registration for our Services;
  • to communicate with or contact you in the future;
  • to provide support and assistance for our Services;
  • to provide the areas of creating personal profiles and view protected content;
  • to provide means of contacting you and deliver you with the billing information;
  • to collect customer feedback and provide support;
  • to provide information on your request to another individuals (e.g., friends or colleagues);
  • to comply with contractual obligations;
  • to collect crash logs when the apps running on your devices crashed or stopped responding;
  • to log your usage behavior in order to improve our user experience;
  • for the CyberLink Product Improvement Program (CPIP): collecting and analyzing how our applications are used helps us improve product design, feature development, and bug fixes; the CPIP program collects information such as how you use features, your search inputs, filenames, and file extension names of the files that you input to our Services; it also includes software application information or device information which does not contain personal info such as software version number, product key, UI language, OS version, device vendor, device model name, manufacturer and model name for specific hardware components (e.g., CPU, GPU), and the name of your device;
  • for product information notifications (Customized Ads / Patches): to receive the latest software patch info or sales offers, including software application information or device information that does not contain personal info, such as software version numbers, product key, UI language, OS version, and device vendor name. If the user opts into the CPIP, the data collected through CPIP may be linked to Customized Ads / Patches to provide more interesting info for users; and
  • for Error Reporting: Error Reporting helps CyberLink to build more stable and robust products by fixing product crash issues; when a product crashes, an Error Reporting dialog pops up and sends debugging information back to CyberLink; the Error Reporting collects only program data and memory dump which does not collect any personal info; if email is provided by the users, users affirm that they agrees that CyberLink may contact users for more information to help CyberLink fix the program crash issues. When the apps running on your devices crashed or become unresponsive, our apps use Fabrics or Google Play services to collect crash logs.

- Purposes of Non-Essential Information (You may choose whether to participate freely):

  • to help find people you know, or people who may know you;
  • to complete subscriptions and payments;
  • to send newsletters, marketing materials, and other information that may be of interest to you;
  • to receive the latest service announcements, updates, upgrades, system enhancements, special offers, and other information.

Manage Your Information

- Service Settings. When using our Services, you may change your service settings at any time and manage certain information shared with other users. For example, you can manage your contacts, groups, and broadcast lists, or use the blocking feature to control which users can communicate with you.

- Delete Your Account. If you wish to stop using our Services, you may contact our customer support at any time to request account deletion. Once your account is deleted, we will remove any undelivered messages and other information associated with that account from our servers and will cease providing our Services. Please note that if you only delete the application from your device without formally requesting account deletion, your information may still remain in our systems for a reasonable period of time.

- In addition, even if you delete your account, copies of messages you have sent may still remain on other users’ devices, and such information is beyond our control.

You may submit the above requests through our customer support. We will process and respond to your request within the period required by applicable laws.

Information Shared Between Our Services and You

Account Information. Your phone number, profile name, and photo (if any) are visible to anyone using our Services. You can manage what specific information you wish others to see by adjusting your profile name, photo, and user ID (private or public mode) in the Service settings.

Your Contacts and Others. Other users you communicate with may store your information or re-share it with others, either within or outside of our Services (including your mobile phone number or messages). You can use your service settings and the blocking features within our Services to manage which users you communicate with and what specific information you share.

Third-Party Providers. We may also share your information with business partners, service providers, authorized third-party agents, or contractors in order to deliver the Services you have subscribed to, including processing orders, handling credit card transactions, hosting meetings or webinars or similar seminar registration, and providing customer support. We only provide these third parties with the minimum amount of your information necessary for to complete/utilize the requested subscription Services. We do not permit third parties to use your information for any purpose other than completing or delivering the requested products or transactions.

As required by law, we may respond to subpoenas, court orders, or similar legal processes by disclosing your personal information and other relevant information if necessary. We may also reserve the right to establish or exercise our legal rights or defend against legal claims when required. We may collect and share personal information, along with any other additional information provided to us in order to investigate, prevent, or take action against illegal activities, suspected fraud, situations involving potential threats to the physical safety of any individual, violations of our terms of services, or as otherwise required by law. Except where you have already provided information or as otherwise permitted under this policy, we will seek your consent before using or sharing your information for any other purpose. To confirm your preferences, we may ask you to take an action on your part, such as checking the appropriate option, to indicate your consent.

Third-Party Services. When you use third-party services integrated with our Services, those services may receive information about what you share with them. For example, if you use a backup service integrated with our Services (such as iCloud or Google Drive), that service will receive the relevant information about what you share with them. If you interact with third-party services linked through our Services, you may be providing information directly to such third parties. Please note that your use of these third-party services is governed by their respective terms of services and privacy policies.

Recording

The Recording feature in U allows participants using our Services to capture any live session content, including but not limited to audio, video, instant messages, application sharing, Microsoft PowerPoint presentations, whiteboards, and polls conducted during a meeting for purposes of archiving or playback. Participants using our Services may choose to record any session as desired, such recordings will be saved locally on their computers, personal devices, or in their own U Cloud Storage (hereinafter referred to as the “Owner”). The Owner may use or share these Recordings just like any other file type. Any content shared during a meeting will be recorded when this Services is used. When a participant starts recording a meeting, all attendees in such meeting will receive a pop-up notification indicating that recording has been initiated. Recording can be disabled simply by turning off the recording feature within the Services.

PLEASE NOTE: Some jurisdictions require explicit consent of all participants in a meeting prior to recording. Participants are solely responsible for understanding and complying with applicable law regarding their legal rights, obligations, and any potential consequences.

Cookie

We use cookies for several purposes, including:

  • Login and Authentication. When you sign in to our website using your personal CyberLink account, we store a unique ID number in an encrypted cookie on your device during login. This cookie allows you to navigate between pages on the website without having to log in again on each page. You may also choose to save your sign-in information so you do not need to sign in again;
  • Personalized Experience. We provide you with a customized experience when you use our Services or visit our website;
  • Analytics. To improve your experiences when using our website and Services, we use cookies and other identifiers to collect usage and performance data. We use cookies to see which areas of our website and which features are popular and to count the number of visits, and
  • Showing Ads. We use cookies to track how many visitors click on ads and to record which ads you have already seen, helping to prevent repeated exposure to the same advertisements.

Control of Cookies

You may set your browser to block all cookies, including those cookie associated with our Services, or indicate when a cookie is being set by us. However, please note that disabling cookies may cause many of our Services to function improperly, for example, we may not be able to remember your language preferences.

  • Most web browsers automatically accept cookies but provide options for you to disable, block, or delete them. For example, in Google Chrome, you can go to [Settings] > [Advanced] > [Content Settings] > [Cookies] to prevent websites from storing and reading cookie data. For information on cookie settings in other browsers, please refer to each browser’s privacy settings or help documentation; and
  • Please note: If you choose to delete cookies, any settings and preferences controlled by those cookies will also be deleted, and you may need to reconfigure them.

When Purchasing (Subscribing to) our Services

When purchasing at CyberLink website, the site functions as a gateway for you to purchase our Services online. While you initiate the purchase on the CyberLink website, the actual transaction is completed on the asknet Solutions AG secure website or any other shopping cart vendors (collectively known as “Shopping Cart Vendors”). To complete a purchase transaction, Shopping Cart Vendors must collect personal information from you, including your credit card number. If you are interested in purchasing our Services through a Shopping Cart Vendor, please review the Privacy Statement of asknet Solutions AG. You can safely make your online purchases through the secure websites of these Shopping Cart Vendors. Numerous other online retailers also sell our Services. However, CyberLink does not directly guarantee the privacy of your personal information when making purchases from other websites. Please refer to the privacy policies posted on those websites directly.

Public Forum Guidelines

The Services includes online community forums. Please note that any information you choose to disclose in these spaces becomes publicly accessible and may be collected and used by others. Exercise caution in disclosing any information and especially personal information.

Security

When you complete and submit any forms on the Services, we use secure servers. During transmission over the Internet, your information is encrypted or hashed using secure communication protocols (TLS/SSL) before reaching us, helping to protect your data. We have also implemented industry-standard security mechanisms and procedures to protect data from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, please note that this does not guarantee that unauthorized third parties will not bypass our mechanisms and procedures to access, disclose, alter, or destroy such information. Additionally, to protect your privacy and security, we require you to create a unique password to verify your identity before granting access to your personal profile. You are solely responsible for maintaining the confidentiality of your unique password and/or any account information. The security of your personal information also depends on how well you protect your unique password. When using the Internet, it is recommended that you take every precaution in protecting your information. For example, regularly change your password, use a combination of letters and numbers when creating passwords, and ensure that you use a secure browser.

Correcting/Updating User Personal Profiles

U allows you to access your account settings page to update or modify your personal information.

Guidelines for Children and Minors

We value and are committed to protecting the privacy of children and minors, and we encourage parents or legal guardians to actively participate in their children’s online activities. To comply with the relevant provisions of the Protection of Children and Youths Welfare and Rights Act and the Civil Code of the Republic of China (Taiwan):

- Children under the age of 14 are not permitted to use the Services.

- Minors aged 14 or older but under 18 may register for and use the Services only with the consent and supervision of a legal guardian.

According to our terms of services, users must confirm that they meet the legal age requirement and, when necessary, provide proof of consent from a legal guardian. We do not knowingly collect or use any online contact information or identifiable offline information relating to children and minors without the consent of a parent or legal guardian. We do not knowingly disclose or distribute any personal identifiable information of children or minors without parental consent. We do not knowingly provide any features or functions that allow children or minors to post or share personal information without parental consent. We do not use games, contests or similar activities directed at children or minors to solicit or encourage them to disclose personal information. If we discover that a user has violated the above age restrictions above, we reserve the right to immediately terminate the account and delete all related data.

Personal Data Rights for Users in the Republic of China (Taiwan)

If you are a resident of the Republic of China (Taiwan), you are entitled to the following rights under Article 3 of the Personal Data Protection Act (PDPA) with respect to your personal data:

  • to inquire about or request access to your personal data;
  • to request a copy of your personal data;
  • to request supplementation or correction of your personal data;
  • to request the cessation of collection, processing, or use of your personal data;
  • to request deletion of your personal data.

California Privacy Rights

If you are a California resident, you have the right to request a list of the “personal information” we may have disclosed to affiliated or non-affiliated third parties for their marketing purposes. California customers may contact us to request a general list of the “personal information” shared and the companies with such information was shared. We may request additional information to verify your identity and ensure the security of your data. We will respond to such requests within 30 days. Merger or Sale

If CyberLink is involved in a merger, acquisition, or sale of assets, we will continue to maintain the confidentiality of any personal information and will notify affected users before any personal information is transferred or becomes subject to a different privacy policy.

Compliance with Laws and Orders

If we have reasonable grounds to believe that doing so is necessary and appropriate, we may collect, use, retain, and share your information:

  • in response to applicable laws or regulations, legal processes, or governmental requests;
  • to enforce these Terms and any other applicable terms and policies, including investigating potential violations;
  • to detect, investigate, prevent, and address fraud, other unlawful activities, and security or technical issues; or
  • to protect the rights, property, and safety of all U Messenger users. You agree to our information practices as described in this Privacy Policy, including the collection, use, processing, and sharing of your information, as well as our operations in other countries where we own or use facilities, service providers, or partners, regardless of where you use our Services. You acknowledge that the laws, regulations, and standards of the countries where your information is stored or processed may differ from those of your own country.

Changes

Our Privacy Policy may be updated from time to time. We will not reduce the rights granted to you under this Privacy Policy without your explicit consent. Any changes to the Privacy Policy will be posted on this page. For any material changes, we will provide a more prominent notice, which may include in-app notifications or email notifications regarding the changes to the Privacy Policy for certain services. If you do not agree with the revised Privacy Policy, you must discontinue using our Services. Please review this Privacy Policy periodically.
